Restoring Constitutional Balance and Fiscal Order to the American Republic

 

 

 

 

 

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

 

 

 

 

 

SECTION 1. SHORT TITLE.

 

 

This Act may be cited as the “Fiscal Accountability and Apportionment Restoration Act” or FAARA.

 

 

 

 

SEC. 2. FINDINGS AND PURPOSE.

 

 

(a) Findings.—Congress finds that—

 

  1. The Constitution of the United States originally required that all federal taxation and debt be apportioned among the several States according to their respective Numbers, thereby ensuring equity, restraint, and accountability;
  2. That principle of apportionment preserved fiscal discipline by linking State and federal responsibility;
  3. Since the ratification of the Sixteenth and Seventeenth Amendments, federal revenue and borrowing have become detached from State oversight, resulting in unrestrained deficits and unsustainable debt;
  4. The national debt, now exceeding $38 trillion, endangers the prosperity and independence of future generations; and
  5. Restoring a system of transparent apportionment and accountability will re-establish fiscal order and renew public confidence in the integrity of the Republic.

 

 

(b) Purpose.—It is the purpose of this Act—

 

  1. To restore fiscal discipline by reintroducing the constitutional principle of apportionment of federal debt among the several States;
  2. To make every level of government accountable to the People through transparency and regular reporting; and
  3. To rebuild confidence in the honesty, solvency, and stewardship of the United States Government.

 

 

 

 

 

SEC. 3. RESTORATION OF APPORTIONMENT.

 

 

  1. The Secretary of the Treasury shall determine annually, as of the first day of each fiscal year, the Total Federal Public Debt of the United States.
  2. That debt shall be apportioned among the several States according to the lawful citizen population of each State, as determined by the most recent decennial census and verified by the Department of Homeland Security.
  3. The Secretary shall transmit to each State—
    (a)  its total apportioned share of the National Debt;
    (b)  the per-citizen share applicable to its lawful citizens; and
    (c)  a comparison to the prior fiscal year.
  4. Such apportionment shall serve as the formal measure of fiscal accountability and equity among the States, and shall not impose any direct payment obligation upon State treasuries.

 

 

 

 

 

SEC. 4. STATE ACCOUNTABILITY REPORTS.

 

 

  1. Within sixty (60) days after receiving its apportionment, each Governor shall issue a State Debt Accountability Report to—
    (a)  the citizens of the State;
    (b)  the State Legislature; and
    (c)  the Congress of the United States.
  2. Each report shall include—
    (a)  the total apportioned debt share of the State;
    (b)  the per-citizen debt burden; and
    (c)  any change from the preceding year.
  3. Reports shall be made publicly available in digital and printed form for citizen review.

 

 

 

 

 

SEC. 5. CONGRESSIONAL ACCOUNTABILITY.

 

 

  1. Each Member of Congress shall affirm, upon taking office, a fiduciary duty to reduce the debt burden borne by their State’s citizens.
  2. The Congressional Record shall include an annual summary of each Member’s voting record showing whether their actions increased or reduced the State’s apportioned debt share.
  3. State Legislatures may issue Fiscal Censure Resolutions expressing disapproval of any Member whose record demonstrates persistent fiscal negligence.
  4. Such resolutions shall be entered into the Congressional Record and publicly posted by the Secretary of the Treasury.

 

 

 

 

 

SEC. 6. TRANSPARENCY AND PUBLIC DISCLOSURE.

 

 

  1. The Department of the Treasury shall establish a National Debt Apportionment Dashboard displaying in real time—
    (a)  the Total National Debt;
    (b)  the per-citizen liability, national and by State; and
    (c)  annual comparative changes.
  2. Each annual federal budget submitted by the President shall include an Apportionment Impact Statement showing how proposed revenues and expenditures will affect each State’s share of the debt.
  3. All debt and apportionment data shall be maintained in a publicly searchable database for educational and oversight purposes.

 

 

 

 

 

SEC. 7. REGULAR ORDER AND BUDGET DISCIPLINE.

 

 

  1. All appropriations bills shall proceed through full committee review, open debate, and recorded vote in accordance with regular order.
  2. No continuing resolution shall extend beyond ninety (90) days except during a formally declared national emergency.
  3. Any omnibus appropriation exceeding two-thousand-five-hundred (2,500) pages shall be certified by the Comptroller General as conforming to regular order, or else publicly noted as a Violation of Regular Order.
  4. The Comptroller General shall submit to Congress an annual certification of compliance with regular order, which shall be included in the Congressional Record.

 

 

 

 

 

SEC. 8. IMPLEMENTATION.

 

 

  1. This Act shall take effect upon enactment.
  2. The Secretary of the Treasury shall issue implementing regulations within one-hundred-eighty (180) days.
  3. The first full National Apportionment Report shall be published within twelve (12) months of enactment.

 

 

 

 

 

SEC. 9. SEVERABILITY.

 

 

If any provision of this Act, or the application thereof, is held invalid, the remainder shall not be affected and shall remain in full force and effect.

 

 

 

 

SEC. 10. STATEMENT OF PRINCIPLE.

 

 

Let it be known that this Act seeks not merely to balance accounts but to restore accountability—

to make Government once again a servant of the People;

to return order where there has been excess, and transparency where there has been concealment;

and to ensure that the Republic shall never again finance its decline with the labor of its unborn children.
